DivotData provides software-generated and AI-assisted practice information from simulator, launch-monitor, and user-provided data. By using DivotData, uploading data, following a drill, sharing a card, or allowing another person to use a DivotData card, you agree that you are responsible for your own decisions, practice environment, supervision, equipment, physical condition, and safety.

This disclaimer applies to DivotData, its owner(s), operator(s), officers, employees, contractors, affiliates, successors, assigns, service providers, and agents, collectively called the DivotData Parties.

Launch-monitor data can identify ball-flight, delivery, dispersion, strike, club-delivery, and retest patterns when those fields are available. It may suggest likely focus areas, but it does not prove the exact mechanical cause of a swing issue. Missing club labels, wrong player labels, bad calibration, misreads, incomplete exports, simulator settings, third-party software changes, or user input errors can make a card incomplete or wrong.

DivotData is not a medical provider, physical therapist, trainer, safety inspector, emergency service, or substitute for professional medical advice. Drills and practice blocks are informational only. Stop immediately if you feel pain, dizziness, unsafe fatigue, or discomfort. Get medical advice before practicing if you have an injury, limitation, medical condition, or concern.

Golf practice and simulator use involve inherent and unpredictable risks. These include, without limitation, muscle strain, overuse injury, slips, trips, falls, impact from clubs or balls, ricochets, screen or net failures, unsafe hitting areas, inadequate spacing, equipment malfunction, third-party software or hardware malfunction, inaccurate measurements, property damage, and serious bodily injury.

You voluntarily assume all risks arising from your use of DivotData, any drill or practice recommendation, any simulator or launch monitor, any facility or bay, and any decision you make based on a Divot Card.

• Use safe judgment and practice within your physical limits.
• Confirm that your hitting area, net, screen, enclosure, mat, flooring, clubs, balls, and surroundings are safe before swinging.
• Follow all facility rules and manufacturer instructions for third-party simulators, launch monitors, software, hardware, and accessories.
• Warm up appropriately, stop when something feels unsafe, and do not attempt a drill that exceeds your ability or physical condition.
• Verify any important practice, coaching, health, safety, or equipment decision with a qualified professional.

Coaches and facilities remain responsible for supervising students, guests, staff, bays, equipment, permissions, waivers, emergency procedures, data rights, and safe use of their premises. DivotData does not inspect facilities, certify coaches, supervise golfers, or guarantee that a guest card is safe or appropriate for a particular person.

DivotData does not guarantee improved performance, injury prevention, correct diagnosis, correct data parsing, simulator compatibility, uninterrupted service, card accuracy, drill suitability, coach approval, facility revenue, guest conversion, or any particular result. Practice outcomes depend on the user, data quality, equipment, environment, and many factors outside DivotData's control.

DivotData may refer to third-party simulators, launch monitors, export formats, software, apps, facilities, coaches, email tools, hosting providers, authentication providers, payment providers, or other services. DivotData does not own or control those third parties and is not responsible for their availability, accuracy, security, safety, support, warranties, malfunction, data loss, or changes.

To the maximum extent permitted by applicable law, you release and waive all claims against the DivotData Parties arising out of or related to your use of DivotData, uploaded data, generated cards, drills, practice blocks, retests, simulator sessions, facility use, coach use, guest-card sharing, software errors, data errors, equipment issues, or third-party services, including claims based on ordinary negligence, personal injury, property damage, data loss, lost profits, lost business, or other losses.

To the maximum extent permitted by applicable law, the DivotData Parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, loss of goodwill, personal injury, property damage, business interruption, software failure, hardware failure, simulator malfunction, or reliance on any Divot Card or practice recommendation. To the maximum extent permitted by applicable law, total liability for any claim will not exceed the greater of the amount you paid DivotData for the service giving rise to the claim during the 12 months before the claim arose or 100 US dollars.

Some jurisdictions do not allow certain disclaimers, releases, exclusions, or liability limits. Nothing on this page is intended to exclude liability that cannot legally be excluded. If any part is unenforceable, it will be enforced to the maximum extent permitted and the remaining terms will continue to apply.
